These are brand names used by the Service Provider and do not denote a registered company or an entry in a register of entrepreneurs.
- Although unregistered business activity is not subject to entry in CEIDG, in relations with consumers the Service Provider is treated as an entrepreneur within the meaning of the Civil Code (Kodeks cywilny) and performs the obligations arising from consumer protection law (see section 12).
- The Terms set out the rules for using the TwojeSystemy website and the rules for submitting enquiries about bespoke technology services.
2. Definitions
For the purposes of the Terms, the following terms mean:
- Terms – these terms of service of the TwojeSystemy website.
- Website or Site – the website run under the TwojeSystemy brand, used to present information about services and to enable contact with the Service Provider.
- Service Provider – the party identified in section 1 of the Terms.
- User – any person who visits the Website or contacts the Service Provider through the contact form or by e-mail.
- Client – a person, company, organisation or other party that holds discussions with the Service Provider about services or enters into a separate agreement with the Service Provider.
- Services – bespoke technology services offered by the Service Provider, in particular modernisation of websites and systems, e-commerce automation, building internal tools and technology consulting.
- Enquiry – a message sent to the Service Provider through the contact form or to the e-mail address kontakt@twojesystemy.com.
- Separate Agreement – the arrangements between the Service Provider and the Client concerning a specific project, in particular the scope of work, remuneration, schedule, liability of the parties, rules of acceptance and rights to the results of the work.
3. Purpose and nature of the Website
- The Website is informational and promotional in nature. It presents the TwojeSystemy brand, areas of specialisation and an illustrative way of collaborating on bespoke technology projects.
- The Website is not a self-service system for ordering services, an online shop or a SaaS platform.
- The Website does not provide user accounts, a login system, a shopping basket, online payments or the automatic conclusion of contracts.
- Information on the Website does not constitute an offer within the meaning of the Civil Code unless expressly stated otherwise in relation to specific content. It is an invitation to get in touch and to discuss possible collaboration.
- The Service Provider may update the content of the Website, including service descriptions, examples of use, indicative price lists and organisational information.
4. Scope of the services presented on the Website
- The Website presents in particular the following categories of services:
- modernisation of websites and existing systems,
- automation of e-commerce processes,
- design and development of internal tools for companies and organisations,
- technology consulting, including problem analysis, selection of solutions and support with technical decisions.
- The Services are bespoke. Their exact scope, price, schedule, method of delivery, technical requirements and the liability of the parties are agreed separately for each project.
- Descriptions of services, examples or outcomes published on the Website are general in nature and do not guarantee identical results in every project. The outcome depends, among other things, on the scope of work, the quality of input data, technical constraints, the cooperation of the parties and the Client’s business circumstances.
5. Contact and the enquiry process
- The User may contact the Service Provider:
- through the contact form available on the Website,
- by e-mail to kontakt@twojesystemy.com.
- The contact form may include the following data: full name or first name, e-mail address, optionally a company name, and the content of the message.
- Submitting the form or an e-mail message does not mean that a contract has been concluded or an order placed, nor does it oblige the Service Provider to accept a project.
- After receiving an Enquiry, the Service Provider may contact the User in order to clarify needs, the scope of the project, budget, deadlines, technical requirements or other terms of collaboration.
- The Service Provider may decline to enter into discussions, to prepare a quotation or to carry out a project, in particular where the project falls outside the Service Provider’s specialisation, is contrary to law or good morals, requires resources that are not available within the given timeframe, or the parties fail to agree the key terms of collaboration.
- A reply to an Enquiry, an initial consultation, a conversation or the preparation of general information does not mean that a contract is automatically concluded, unless the parties expressly agree otherwise in separate correspondence or in an agreement.
6. Agreeing scope, price and delivery dates
- Each project is discussed individually.
- The scope of work, remuneration, deadlines, billing rules, the manner of handing over materials, access and information, acceptance rules and any rights to the results of the work should be set out in a Separate Agreement, an offer accepted by the parties, an order, e-mail correspondence or another agreed document.
- Where the Website shows information on prices, packages or indicative budgets, it is for information only unless expressly stated otherwise. The final quotation depends on the agreed scope and the terms of the project.
- Delivery dates are agreed individually and may depend on the Service Provider’s availability, the Client’s timely provision of information, technical access, decisions on the Client’s side and factors beyond the parties’ control.
- The Service Provider is under no obligation to start work before the essential terms of the project have been agreed and, where so agreed, before a Separate Agreement has been concluded or an initial payment received.
7. Rules for using the Website
- The User may use the Website in accordance with its purpose, the Terms, the law and good morals.
- The User should provide in the contact form data that is true, current and belongs to the User or to the entity the User represents.
- It is prohibited to use the Website in a way that:
- infringes the law, the rights of third parties or good morals,
- disrupts the operation of the Website or its technical infrastructure,
- involves sending spam or content that is unlawful, offensive or misleading, or that contains malicious software,
- involves an attempt at unauthorised access to systems, data, source code, administration panels or other resources,
- uses automated tools in a manner that places an excessive load on the Website,
- impersonates another person, company or organisation,
- serves to breach security, to carry out penetration tests without the Service Provider’s consent or to circumvent safeguards.
- The Service Provider may take technical and organisational measures to protect the Website, to secure correspondence and to limit abuse.
8. Technical requirements
- Using the Website requires a device with Internet access, an up-to-date web browser and, when contacting the Service Provider, the ability to use e-mail.
- The correct operation of the Website may depend on device, browser and network settings and on the availability of external technical services.
- The Service Provider may carry out technical work, updates or changes to the Website that temporarily limit the availability of some features.
9. Intellectual property and Website materials
- The content, layout, graphic elements, texts, names, logotypes, materials, presentation concepts and other elements of the Website may be protected by intellectual property rights of the Service Provider or of authorised third parties.
- Using the Website does not transfer to the User any intellectual property rights in the Website, the TwojeSystemy brand, the materials or the results of the Service Provider’s work.
- The User may browse the content of the Website and use it to the extent permitted by law and solely for the User’s own informational needs connected with evaluating the Service Provider’s offer.
- Copying, distributing, modifying, making publicly available, commercially exploiting or removing authorship marks from Website materials requires the Service Provider’s prior consent, unless the law permits such action without consent.
- The rules for using materials, code, documentation, designs, analyses or other results produced for the Client should be set out in a Separate Agreement.
10. Complaints and contact regarding the Website or services
- In matters concerning the operation of the Website, the contact form, the content of the Terms, correspondence received or the services presented on the Website, the User may contact the Service Provider at the e-mail address kontakt@twojesystemy.com.
- The report should include a description of the matter, details enabling a reply and, where it concerns a technical problem, information helpful in reproducing it, for example the page address, a description of the error, the date and time the problem occurred and the type of device or browser.
- The Service Provider responds to reports within a reasonable time appropriate to the nature of the matter. If a separate agreement provides for a different complaint or support procedure, the provisions of that agreement apply.
- Merely reporting a problem does not limit the rights of the User or the Client arising under mandatory provisions of law or a concluded Separate Agreement.
11. Liability
- The Service Provider endeavours to keep the information on the Website current, reliable and useful; however, the content of the Website is general and informational in nature.
- Business, technical or organisational decisions taken solely on the basis of the general content of the Website are taken by the User at the User’s own responsibility. Before taking decisions concerning a specific project, it is advisable to discuss the details with the Service Provider or an appropriate specialist.
- The Service Provider is not liable for the consequences of using the Website in a manner contrary to the Terms, the law, good morals or the purpose of the Website.
- The Service Provider does not guarantee uninterrupted availability of the Website or the absence of technical errors, but may remedy problems it notices as far as its organisational and technical capabilities allow.
- Nothing in the Terms excludes or limits liability that cannot be excluded or limited under applicable law, in particular towards consumers or entrepreneurs who are entitled to selected consumer rights.
- The detailed liability of the parties for the delivery of a specific project should follow from a Separate Agreement.
12. Consumers and entrepreneurs with consumer rights
- The Website and the services described on it are addressed primarily to companies, organisations and B2B clients; however, the Service Provider may also conclude contracts with consumers (natural persons entering into a contract for purposes not directly related to their business or professional activity).
- Because the Service Provider conducts unregistered business activity, in relations with consumers the Service Provider is treated as an entrepreneur and applies consumer protection law, in particular the Act on Consumer Rights (ustawa o prawach konsumenta) and the Civil Code. The Terms do not limit the rights that consumers have under mandatory provisions of law.
- Right of withdrawal from the contract. A consumer who concludes a distance contract with the Service Provider may, as a rule, withdraw from it within 14 days without giving a reason. The Service Provider refunds payments received no later than 14 days from the day on which the statement of withdrawal is received. Before the contract is concluded, the Service Provider provides the consumer with information about the right of withdrawal and a model withdrawal form.
- Exceptions to the right of withdrawal. The right of withdrawal does not apply, among other cases, where the Service Provider has fully performed the service with the consumer’s express prior consent, the consumer having been informed before the work began that the right of withdrawal will be lost once the service has been performed, and also in the case of digital content or digital services supplied on the terms set out in the Act on Consumer Rights. If, at the consumer’s express request, work is to begin before the withdrawal period expires, the Service Provider will obtain an appropriate statement from the consumer.
- Complaints and conformity of performance with the contract. A consumer may submit a complaint about a service to kontakt@twojesystemy.com. The Service Provider replies to a consumer’s complaint within 14 days of receiving it; failure to reply within that period means that the complaint is deemed accepted. The consumer may be entitled to remedies for a lack of conformity of the performance with the contract on the terms set out in the Act on Consumer Rights.
- Out-of-court dispute resolution. A consumer may use out-of-court methods of handling complaints and pursuing claims, in particular the assistance of the county (municipal) consumer ombudsman (powiatowy (miejski) rzecznik konsumentów), the Voivodeship Inspectorate of Trade Inspection (Wojewódzki Inspektorat Inspekcji Handlowej) and the information provided by the President of the Office of Competition and Consumer Protection (Prezes Urzędu Ochrony Konkurencji i Konsumentów, UOKiK).
- Detailed terms, the information duties required for contracts with consumers and the model withdrawal form are provided to the consumer before a specific Separate Agreement is concluded.
13. Personal data and privacy
- Information on the processing of Users’ personal data, in particular data provided through the contact form or by e-mail, should be described in the Privacy Policy available on the Website.
- The Terms do not replace the Privacy Policy. For questions about personal data, the User may contact the Service Provider at kontakt@twojesystemy.com.
- If the Website begins to use analytics or marketing tools, cookies other than technical ones, or external data processors, the legal documents of the Website should be updated accordingly.
14. Changes to the Terms
- The Service Provider may amend the Terms in particular in the event of:
- a change in the Service Provider’s details,
- a change in the scope or manner of operation of the Website,
- the addition of new features, forms, contact channels or a sales model,
- a change in the law or a need to clarify provisions,
- the need to correct obvious errors, ambiguities or outdated information.
- The current version of the Terms should be available on the Website.
- An amendment to the Terms does not automatically change the terms of Separate Agreements concluded before its publication, unless the parties expressly agree otherwise or mandatory provisions of law require otherwise.
15. Final provisions
- Matters not regulated by the Terms are governed by generally applicable law.
- If any provision of the Terms proves invalid or ineffective, this does not affect the validity of the remaining provisions, and the parties should seek to apply the solution closest to the purpose of the invalid or ineffective provision, to the extent legally permissible.
- The Terms apply from 24.06.2026.
